TERMS AND CONDITIONS - *SCAPE Marketplace

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE MAKING PAYMENT FOR RENTAL OF BOOTH AT *SCAPE Marketplace.

By proceeding with payment, you signify your agreement to these Terms and Conditions, which will enter into force upon successful payment for the selected booth rental. If you do not agree to these Terms and Conditions, do not use this site.

 

Failure in abiding by any of the following terms and conditions may result in the Vendor bearing any compensation, penalties and/ or legal fees resulted from the violation. It may also subject Vendor to eviction from this Bazaar and as a result, no refund or any other form of compensation in monetary terms or otherwise, will be awarded to the Vendor concerned.

 

The Duke’s Bazaars Pte. Ltd. is the official partner and organiser of the *SCAPE Marketplace.

 

1.         Definition

 

1.1         “Organiser” refers to THE DUKE'S BAZAARS PTE. LTD. (Business Registration Number: 201416160E).

1.2         “Applicant” refers to the person who is making a booking of booth and date prior to booking confirmation from the Organiser.

1.3         “Vendor” refers to the person who has successfully made payment for booth rental at *Scape Marketplace and issued with a booking confirmation from the Organiser.

1.4         “Youth Market” refers to *Scape Marketplace.

 

2.         Eligibility and Requirements

 

2.1       The Vendor must be at least 18 years old (passed birthday) to make a booking and payment for booth rental. 

2.2       The Vendor who has successfully booked and paid for a booth must be present to operate the booth at the Bazaar.

2.3       The Vendor must be either Singapore Citizen or Singapore Permanent Resident. Dependent’s Pass Holders may write in to enquire eligibility. All other foreigners are Not Eligible to operate as a Vendor at this Bazaar.

2.4       Upon request, the Vendor shall produce the official receipt for payment of booth rental and his/her NRIC for verification purpose

2.5       Assignment and/ or contracting of booth by the Vendor to any other person is strictly prohibited.

 

3          Payment and Confirmation

 

3.1       Applicant who has selected booth and date for booking, will proceed to pay by either (a) credit/ debit card payment (via Paypal) or (b) bank transfer of fund.

3.2       For credit/ debit card payment (via Paypal), a booking confirmation and receipt will be notified immediately via email, upon successful payment.

3.3       For payment by bank transfer of fund, the booking will be reserved for 48 hours. Upon confirmation of payment received, a booking confirmation and receipt will be notified via email, otherwise the booking will be void and the booth reserved be released for booking, and a notification of non-booking will be issued by the Organiser via email.

3.4       Payment of booth rental can be made in conjunction with valid discount/ promotional coupon(s) issued by the Organiser.

 

4          Booth Operation

 

4.1       The current operating hours of the *Scape Marketplace as determined by the Organiser are 12pm to 10pm on every Friday to Sunday, Public Holiday as well as any other designated day for *Scape Marketplace operation. The Organiser reserves the rights to adjust the operating hours where it deems fit.

4.2       The Vendor is only allowed to set up the allocated booth on the allocated day of *Scape Marketplace operation, between 12pm to 3pm, unless otherwise stated.  

4.3       The Vendor who sets up the allocated booth later than the set up time as stipulated in condition 4.1 will be subject to eviction from the *Scape Marketplace and as a result, no refund or any other form of compensation in monetary terms or otherwise, will be awarded to the Vendor concerned.

4.4       The Vendor who did not show up on the allocated day of *SCAPE Marketplace operation upon confirmation from the organiser at the *Scape Marketplace will result in full forfeiture of booth rental.

4.5       The Vendor shall report to the Organiser’s booth for registration and signing out of the official *Scape Marketplace table cloth for each table used at the booth. He/ She will return the table cloth in proper and undamaged condition after the day's operation.

4.6       The Vendor shall pack up and vacate the allocated booth by end time of the marketplace operation, unless otherwise stated.

4.7       Applicant who did not receive any booking confirmation from the Organiser will not be allowed to operate as a Vendor at the selected booth.

4.8       The Vendor is not allowed to relocate to another booth without seeking the permission of the Organiser at all times and shall not shift/ adjust booth set up outside of the permissible space, resulting in the obstruction of other Vendor(s)’ operation and/ or the walkway.

4.9       The Vendor is not allowed to self-help to chair(s), table(s) or clothe-rack(s) from other booth(s). For add-on fixtures, the Vendor can approach the Organiser directly for rental.

4.10     Each booth will accommodate a maximum of 3 persons including the Vendor.

4.11     The Vendor shall return the table cloth as well as any rented clothe-rack to the Organiser before vacating the Youth Market.

4.12     The Vendor shall be responsible for the disposal of his/her booth’s trash and refuse by the end of the bazaar operation. All trash and refuse can be disposed of at litter bins located within the bazaar operating area. 

 

5          Booth Requirements

 

5.1       Each standard booth comprises a 2m x 2m gazebo, lighting, one 4ft x 2ft table and one plastic chair.

5.2       For the add-on of table or clothe-rack, the permissible combination shall be as follows:

(a)  2 tables, no clothe-rack;

(b)  1 table, 1 clothe-rack; or

(c)  2 clothe-rack, no table.

5.3       The add-on table or clothe-rack must be joined perpendicularly (forming an ‘L’ shape setup) to the default table with frontage not exceeding 6ft wide.  

5.4       Extension of table by any other means not stated in condition 5.3, is strictly prohibited.

5.5       Each booth can allow a maximum of 2 additional chairs.

5.6       The Vendor shall use *SCAPE Marketplace table-cloth for each table used at the booth.  

5.7       The Vendor is required to clear away any unwanted item or trash at his/ her booth area before vacating the bazaar.

5.7       The Organiser will provide side flab covers for Gazebo booths in the event of wet weather, However, the Vendor is strongly advised to bring his/ her own covers to protect his/ her products in event of wet weather.

5.8       There is NO power-supply available for *SCAPE Marketplace.

5.9       Lightings are provided only for all gazebo booths. Vendor are advised to be self-equipped with his/ her own lightings and battery pack for extra illumination, where necessary.

5.10     *Scape Marketplace strictly does NOT allow the Vendor to place his/ her goods or property overnight at the bazaar operating area after operating hours.

 

6          Display and Merchandising Requirements

 

6.1       The Vendor can only sell merchandise declared at time of booking at the *Scape Marketplace.

6.2       Sale of the following items is strictly prohibited:

(a) Pre-owned apparels, clothing, accessories, bags and footwear;

(b) Food and beverage;

(c) Unlicensed, flammable, banned products or items which violate any trademark or copyright;

(d) Merchandise similar to those sold by existing *SCAPE Mall shop tenants; and

(e) Any other items, merchandise or goods that are prohibited by law.

6.3       All Cosmetic/ Skincare/ Nail/ Eye/ Perfume/ Bathe/ Perfume/ Hair products that come in contact with the human skin, eye or for oral consumption are subject to the Health Science Authority's (HSA) approval. Vendor who wish to sell such merchandise must provide HSA's Product Notification Letter of Acknowledgement issued to the Vendor for the Organiser’s verification prior to booking of booth.

6.4       All merchandise shall not infringe the Copyright Act, be it design/ logo/ brands of any major Trademark and Licensed products. The Vendor who wishes to sell merchandise of major brands and logos, must provide official documents such as official receipts as proof that the Vendor had rightfully acquired such merchandise from suppliers selling the official licensed merchandise.

6.5       All merchandise for sale are to be displayed neatly on the assigned table(s) or clothe-rack(s). No product shall be placed/ displayed on the floor/ chairs at all times.

6.6       The Vendor is hereby given notice not to abuse by hanging or sticking anything onto the properties (Tents, Tables, Chairs, etc) provided by the Organiser and/ or properties of *Scape Mall.

6.7       No products, publication materials or banners are allowed on any part of *SCAPE's building/ structure, other than the permissible limits restricted to the assigned booth.

6.8       The Vendor shall not at all times during bazaar operation, engage in messy cheap-selling (of crumpled /used items) on the table/ floor, in boxes/ carriers/ luggage.

6.9       The Vendor shall not, at all times during bazaar operation, engage in touting, hard-selling, roadshows, special promotions, etc..

 

7          Change or Cancellation of Booking

 

7.1       Any request to change or cancel a booking has to be made by the Vendor via email to the Organiser, notifying the request at least 7 days before the date of operation by the Vendor. An Admin-Fee (amounting to S$15 or 25% of the total booking fee, whichever is higher) will be levied for EACH request for change or cancellation.

7.2       Any successful request to change or cancel a booking, which results in the partial refund of the booking fee, shall be returned by the Organiser to the Vendor, in the form of a valid refund coupon (with the actual value of refund amount) for the Vendor’s use in subsequent booking of booth with the Organiser.

7.3       Any request to change or cancel a booking within 7 days from the date of operation by the Vendor, will NOT be entertained, and as a result, no refund or any other form of compensation in monetary terms or otherwise, will be awarded to the Vendor concerned.

 

8          Curated Zone

 

8.1       The curated zone as defined by the Organiser shall only be made available for vendors who are selling handmade, handcrafted, self-designed and artisanal products, etc..

8.2       Applicants who wish to book booth(s) at the curated zone, will need to email the Organiser at [email protected] for a one-time screening and approval. Once approved, the applicant will be allowed to make the booking, henceforth.

8.3       Applicants who have booked curated zone booth(s), prior to seeking approval from the Organiser will be cancelled and the booking fee be refunded as in accordance with the prevailing refund policy stipulated at paragraph 7 above.

 

9          Laws and Regulations

 

9.1       The Vendor shall be responsible for complying with all applicable laws and regulations in Singapore as imposed by the Government or lawful bodies of the Republic of Singapore (including but is not limited to any item that breaches the intellectual property rights of any third party; any item [including but not limited to cosmetics, food and drinks etc.] that requires the prior approval of the relevant licensing authorities, such as the National Environment Agency (NEA), HSA etc., and for which prior approval have not been obtained; any dangerous, offensive, pornographic or illegal items; any form of alcohol.

 

10        Conduct and Behaviour

 

10.1     The Vendor is hereby given notice to conduct his/ her business at the *Scape Marketplace operating in a professional manner so as not to give cause for complaints from occupants of *Scape Mall or the public and to ensure that the image of Organiser is not adversely affected.

10.2     The Vendor shall respect the health and safety of fellow Vendor(s). No acts or threats of physical and/ or verbal violence against another person and disorderly conduct, are allowed.

10.3     The Vendor is hereby given notice to keep the bazaar operating area clean and tidy, and shall not litter, deface or damage the facility. The area must be cleared and kept clean after use, with the waste, boxes, cardboard and refuse properly disposed of in the nearby litter bins.

10.4     No properties within the *Scape Marketplace operating area shall be removed or to be shifted unless prior approval is given by the Organiser.

10.5     The Organiser reserves the rights to report incident(s) of theft to the Police and it shall be dealt with under laws and regulations in Singapore as imposed by the Government or lawful bodies of the Republic of Singapore.

10.6     In the event of any loss/ removal/ damage caused to the *Scape Marketplace operating area and its furnishings/ fixtures, the Vendor will be held liable for the loss, removal or damage and shall pay Organiser such sums as Organiser may determine for the loss or damage caused to the aforesaid.

10.7     In the event that the Vendor contravenes any statute or regulations or which may expose the Organiser to any fine or penalty by reason thereof, the Vendor shall be held fully responsible and liable to pay the full fine or penalty caused to the aforesaid.

 

11        Indemnity

 

11.1     The Vendor shall indemnify the Organiser for costs, expenses and claims which the Organiser may incur arising out of or in connection with the sale of the Vendor's merchandise or negligence or wilful misconduct on the part of the Vendor or its representatives, agents or employees.

11.2     In the event any legal action or proceeding taken against the Organiser arising from the circumstances stipulated in condition 10.1, the Vendor hereby authorises the Organiser to release information pertaining to Vendor as deemed necessary to such parties taking legal action.

11.3     The Management of *SCAPE and the Organiser shall not be held responsible for any dispute or liability arising from the sale of merchandise by the Vendor.

11.4     The Organiser is only involved in the rental of booths within *SCAPE premises as designated for *Scape Marketplace operation. All merchandise on sale at the *Scape Marketplace are deemed to belong to the respective Vendors and such Vendor shall assume full responsibility with regard to the quality and authenticity of the merchandise on sale.

11.5     *Scape Marketplace is a Rain or Shine Even and therefore, no refund of booking fee (fully or partially) or any other compensation in monetary terms or otherwise, shall be awarded to the Vendor due to weather elements.

11.6     For the avoidance of doubt, under no circumstances will the Vendor hold Organizer responsible for any damage, lost or defacement of goods or property on display occurring, during, before or after the operating of the Youth Market, no matter how it was caused.

11.7     The Organiser will not be held liable and/or responsible for any injuries, illness and/ or death that occurred before and/ or after and/ or during the operating of *Scape Marketplace.

11.8     The Organiser is not responsible for poor sales or bad response during any of *Scape Marketplace operating days, and shall not be obligated to refund or compensate in monetary terms or in kind, as demanded by the Vendor.

11.9     The Organiser reserves the rights to cancel any *Scape Marketplace operating day without any prior notice, in the event of any unforeseen circumstances.

11.10   The Organiser reserves all rights to ban any Vendor from booking in future in the event of any dispute or violation of the aforementioned terms and conditions.

11.11   The Organiser reserves the right to amend any terms and conditions without prior notice.

11.12   The Organiser reserves the right to reject any booking application based on its absolute sole discretion without assigning any reasons.

11.13   The Organiser reserves the right to terminate a contract immediately by notice in writing to the Vendor without providing any reason. Such termination shall not prejudice the rights and liabilities of either party against the other for any breach of the contract.

3.5       Payment of booth rental can be made in conjunction with a valid discount/ promotional coupon issued by the Organiser.

4.2       The Vendor is only allowed to set up the allocated booth on the allocated day of Bazaar operation, from start time of Bazaar operation and no later than 2 hours after start time, unless otherwise stated.

4.3       The Vendor who sets up the allocated booth later than the set up time as stipulated in condition 4.1 will be subject to eviction from the Bazaar and as a result, no refund or any other form of compensation in monetary terms or otherwise, will be awarded to the Vendor concerned.

4.4       The Vendor who did not show up on the allocated day of Bazaar operation upon confirmation from the organiser at the Bazaar will result in full forfeiture of booth rental.

5.10     Sun Plaza Bazaar strictly does not allow the Vendor to place his/ her goods or property overnight at the Bazaar operating area after operating hours.

9.7       In the event that the Vendor contravenes any statute or regulations or which may expose the Organiser to any fine or penalty by reason thereof, the Vendor shall be held fully responsible and liable to pay the full fine or penalty caused to the aforesaid.

 

10        Indemnity

 

10.1     The Vendor shall indemnify the Organiser for costs, expenses and claims which the Organiser may incur arising out of or in connection with the sale of the Vendor's merchandise or negligence or wilful misconduct on the part of the Vendor or its representatives, agents or employees.

10.2     In the event any legal action or proceeding taken against the Organiser arising from the circumstances stipulated in condition 10.1, the Vendor hereby authorises the Organiser to release information pertaining to Vendor as deemed necessary to such parties taking legal action.

10.3     The Management of Sun Plaza and the Organiser shall not be held responsible for any dispute or liability arising from the sale of merchandise by the Vendor.

10.4     The Organiser is only involved in the rental of booths within Sun Plaza premises as designated for Bazaar operation. All merchandise on sale at the Bazaar are deemed to belong to the respective Vendors and such Vendor shall assume full responsibility with regard to the quality and authenticity of the merchandise on sale.

10.5     Sun Plaza Bazaar is a Rain or Shine Even and therefore, no refund of booking fee (fully or partially) or any other compensation in monetary terms or otherwise, shall be awarded to the Vendor due to weather elements.

10.6     For the avoidance of doubt, under no circumstances will the Vendor hold Organiser responsible for any damage, lost or defacement of goods or property on display occurring, during, before or after the operating of the Bazaar, no matter how it was caused.

10.7     The Organiser will not be held liable and/or responsible for any injuries, illness and/ or death that occurred before and/ or after and/ or during the operating of Bazaar.

10.8     The Organiser is not responsible for poor sales or bad response during any of Bazaar operating days, and shall not be obligated to refund or compensate in monetary terms or in kind, as demanded by the Vendor.

10.9     The Organiser reserves the rights to cancel any Bazaar operating day without any prior notice, in the event of any unforeseen circumstances.

10.10   The Organiser reserves all rights to ban any Vendor from booking in future in the event of any dispute or violation of the aforementioned terms and conditions.

10.11   The Organiser reserves the right to amend any terms and conditions without prior notice.

10.12   The Organiser reserves the right to reject any booking application based on its absolute sole discretion without assigning any reasons.

10.13   The Organiser reserves the right to terminate a contract immediately by notice in writing to the Vendor without providing any reason. Such termination shall not prejudice the rights and liabilities of either party against the other for any breach of the contract.
